Importing Fresh Fruits and Vegetables to Canada
With the Safe Food for Canadians Act going into effect on January 15, 2019, it is important to see how this will affect importers of fresh fruits and vegetables into Canada.
Canada is recognized as having one of the more robust food safety systems in the world. The Safe Food for Canadians Act (SFCA) aims to strengthen existing food systems by focusing on prevention and enabling the faster removal of unsafe foods from the market.
The SFCA became law in Canada in November 2012 in response to the increasing risks and challenges resulting from the increasing volume and complexity of food production. The goal is to reduce the administrative burden on businesses by replacing the 14 sets of rules with 1.
In addition to obtaining an importer number, currently, importers of fresh fruit and vegetables must have a CFIA Production License or DRC Membership.
The fee for a CFIA Production License is $1075.00 plus tax for the year. For DRC Membership, the annual fee is $1097.00 plus tax. CFIA is currently recommending obtaining a DRC Membership as they are phased out of the CFIA Production License in the coming months.
You can find DRC Membership info here. However, there are exceptions to both. If you market fresh fruit and vegetables directly to consumers for a total invoice value of less than $230,000 per calendar year, you are exempt from licensing terms.
The new regulations that will come into force are known as Safe Foods for Canada Regulations or SFCR. Under the SFCR, food businesses will be required to obtain a license if they undertake any of the following activities;
- Import of food
- Producing, processing, treating, preserving, grading, packaging, or labeling food for export or shipment across provincial or territorial boundaries
- Food exports that require export certificates – even if they do not prepare food
- Slaughter of food animals whose meat products originate for export or for shipment across provincial or territorial boundaries
- Storing and handling imported meat products for inspection by the Canadian Food Inspection Agency (CFIA)
The license will help the CFIA better identify food safety risks to target inspections, better communicate critical food safety information to businesses, and take enforcement action when regulatory requirements are not met. These enforcement actions can range from requiring corrective action to suspending or canceling licenses.
